Agreement
Using CapoFleet means accepting these terms and our Privacy policy. They are written for operators (the account holders). Renters who use tokenized pages are also covered where relevant.
What CapoFleet is
CapoFleet is software that helps operators manage vehicles, renters, rentals, payments, and messages.
CapoFleet is not a party to any rental agreement, does not own or rent vehicles, does not provide insurance, is not a lender, broker, or dealer, and does not provide legal, tax, or insurance advice. The rental relationship is strictly between the operator and the renter.
The operator is solely responsible for their business, their vehicles, their compliance (licensing, insurance, tax including any state rental taxes), and their agreements with renters.
Accounts
Provide accurate information. Keep your credentials secure. You are responsible for activity under the account. One human is accountable per operator account.
Acceptable use
You may not:
- Use the service for anything unlawful
- Harass people or send abusive messages
- Use the messaging tools for marketing or anything the recipient has not consented to
- Scrape the service
- Attempt to access other operators’ data
- Upload content you do not have rights to
Payments and Stripe
Operators connect their own Stripe account. Funds from renters flow to the operator’s Stripe account, not to CapoFleet. Stripe’s terms govern that relationship.
CapoFleet may charge subscription or service fees (currently free during beta) and will give notice before charging. Operators are responsible for refunds, chargebacks, and disputes with their renters.
Messaging
Operators authorise CapoFleet to send transactional messages on their behalf, and warrant they have obtained proper consent from their renters. Operators must not use the platform to send marketing messages. CapoFleet may suspend messaging that risks carrier violations.
Renter-facing pages
Tokenized links are personal to the recipient. Sharing them exposes that person’s information. Report a compromised link to the operator or support@capofleet.com.
Beta
The service is in active development, may change or break, and is provided as-is. Features described may be removed. Data export is available on request.
Disclaimers and limitation of liability
The service is provided as-is, without warranties of any kind. To the maximum extent permitted by law, CapoFleet is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or vehicle-related losses.
Aggregate liability is capped at the fees paid to CapoFleet in the prior 12 months or $100 during the free beta, whichever is greater. Nothing in these terms limits liability that cannot lawfully be limited.
Indemnity
The operator indemnifies CapoFleet for claims arising from their rentals, vehicles, renters, or non-compliance.
Termination
Either side may end use of the service. The operator may export or request their data. CapoFleet may suspend an account for abuse or legal risk.
Governing law and disputes
These terms are governed by the laws of the State of Texas. Disputes will be heard in Texas courts. Try informal resolution first by emailing support@capofleet.com.
Changes
Changes are posted with a new “last updated” date. Continued use accepts them.
